These Terms and Conditions (“Terms”) govern the use of Helping Trades Scale website and the purchase and provision of services from Helping Trades Scale.
By using our website, requesting our services, accepting a quotation or proposal, or making payment for a service, you agree to be bound by these Terms.
Please read them carefully before purchasing or using our services.
1. About Us
Helping Trades Scale provides digital marketing and online business growth services to businesses in the United Kingdom.
Our services may include Google Business Profile optimisation and management, local online visibility services, website-related services and other digital marketing or business growth services that we may introduce from time to time.
Business name: Helping Trades Scale
Email: info@helpingtradesscaleteam.com
If you have any questions regarding these Terms, please contact us using the details above.
2. Our Services
The exact scope of the services we provide will be described on our website, order page, quotation, proposal, invoice or other written agreement provided to you.
Depending on the service selected, our work may be provided as:
a one-off service;
an ongoing monthly service;
a fixed-term project; or
another arrangement agreed with you in writing.
You are responsible for reviewing the scope of the service before placing an order or approving work.
Any work outside the agreed scope may be subject to an additional charge. We will normally discuss additional work and any associated costs with you before proceeding.
3. Google Business Profile Services
Where you purchase Google Business Profile optimisation or management services, you authorise Helping Trades Scale to access and make agreed changes to your Google Business Profile on your behalf.
This may include, where appropriate, reviewing or updating business information, categories, services, descriptions, photographs and other profile information, as well as carrying out ongoing profile management where included in your chosen service.
You remain responsible for ensuring that all information you provide to us about your business is complete, accurate and lawful.
We will not knowingly add false, misleading or inaccurate information to a Google Business Profile.
4. Access to Third-Party Accounts
Some services may require access to third-party platforms or accounts, such as Google Business Profile, website platforms, analytics services or other digital tools.
Where possible, you should provide access through the platform’s official user, manager or administrator access features rather than sharing passwords.
You authorise us to use the access provided solely for the purpose of carrying out the agreed services.
You remain the owner of your accounts and are responsible for maintaining appropriate account security.
5. Google and Other Third-Party Platforms
Helping Trades Scale is an independent business and is not Google, nor are we affiliated with, endorsed by or acting on behalf of Google unless expressly stated otherwise.
Google and other third-party platforms operate according to their own terms, policies, systems and algorithms, which may change at any time and are outside our control.
We cannot guarantee that:
Google will approve or accept a particular change;
a profile will be verified or remain verified;
a profile will appear in a particular position;
your business will achieve a specific ranking;
your listing will receive a particular number of views, calls, enquiries or customers; or
a third-party platform will remain available or operate in the same way.
We will provide our services using reasonable care and skill, but we cannot be held responsible for changes, suspensions, restrictions, outages or decisions made by third-party platforms that are outside our reasonable control.
6. No Guarantee of Rankings or Results
Digital marketing results can be influenced by many factors outside our control, including competition, location, customer behaviour, search algorithms, the strength of competing businesses and changes made by third-party platforms.
For this reason, Helping Trades Scale does not guarantee:
first-place or specific Google rankings;
placement within Google’s local results or map results;
a particular increase in website traffic or profile views;
a particular number of calls, leads, enquiries or sales; or
any specific financial return from our services.
Any examples, estimates or discussions regarding potential results are illustrative only and should not be treated as a guarantee.
7. Your Responsibilities
To enable us to provide our services effectively, you agree to:
provide accurate and complete information about your business;
provide the access reasonably required to carry out the service;
respond to reasonable requests for information or approval;
ensure you have the right to provide any photographs, logos, text or other materials supplied to us;
notify us if important business information changes; and
use our services only for lawful purposes.
We are not responsible for delays or problems caused by incomplete, inaccurate or late information supplied by you.
8. Prices and Payment
Prices for our services will be shown on our website, quotation, proposal, invoice or order page, as applicable.
Unless stated otherwise, payment is due in accordance with the payment terms provided when you purchase or approve the service.
We reserve the right to change our prices from time to time. Any price change will not normally affect work that has already been paid for or formally agreed, unless otherwise agreed with you.
Where additional work is requested outside the original scope, we may provide a separate quotation or charge an additional fee with your agreement.
9. One-Off Services
Where you purchase a one-off optimisation or project service, the price covers only the work described within the relevant service package, quotation or agreement.
Ongoing management, monitoring, updates or additional work after completion are not included unless specifically stated.
If additional work is requested following completion, this may be quoted separately or provided under an ongoing service plan.
10. Monthly and Recurring Services
Where you purchase an ongoing monthly management service, fees will be charged according to the billing arrangement agreed at the time of purchase.
Unless a minimum term has been expressly agreed, you may request cancellation of an ongoing service in accordance with the cancellation terms provided when you purchase the service.
Cancellation prevents future service periods from being provided and charged, subject to any payments already due.
Fees already paid for a service period that has commenced are normally non-refundable except where required by law or expressly agreed otherwise.
We reserve the right to change the price of an ongoing service by providing reasonable notice before the new price takes effect.
11. Cancellations and Refunds
Because our services involve professional time and work that may begin shortly after an order is placed, refund eligibility will depend on whether work has commenced and the nature of the service purchased.
If you wish to cancel a service, you should contact us as soon as possible.
Where work has not yet commenced, we may agree to cancel the service and issue a refund, subject to any reasonable costs already incurred.
Where work has already commenced or has been completed, we may deduct or retain an amount that reasonably reflects the work already carried out, subject to your applicable statutory rights.
Any specific cancellation or refund conditions shown during the ordering process or agreed in writing will also apply.
Nothing in these Terms limits any cancellation, refund or other rights that you are legally entitled to.
12. Project Timescales
Any completion dates or timescales we provide are estimates unless expressly agreed otherwise in writing.
We will make reasonable efforts to complete work within the expected timeframe, but delays may occur due to circumstances including:
waiting for information or approval from you;
Google verification or review processes;
third-party platform delays;
technical problems;
changes to the agreed scope; or
circumstances outside our reasonable control.
We are not responsible for delays caused by factors outside our reasonable control.
13. Approvals
Where we ask you to review or approve information, content or work, you are responsible for checking it carefully.
Once something has been approved by you, additional changes requested afterwards may be treated as additional work where they fall outside the agreed service.
If we identify an obvious error after approval, we will make reasonable efforts to correct it.
14. Intellectual Property
Unless otherwise agreed, Helping Trades Scale retains ownership of its own processes, systems, templates, methods, know-how and other pre-existing intellectual property used to provide the services.
You retain ownership of materials you provide to us, including your business name, branding, photographs and other content, subject to any third-party rights.
You grant us permission to use materials supplied by you where reasonably necessary to provide the agreed services.
Where we create bespoke deliverables specifically for you, ownership or usage rights will be determined by the relevant service agreement or quotation.
15. Portfolio and Marketing Use
We may wish to reference completed work in our portfolio, website or marketing materials.
Where this involves displaying your branding, website, business information or identifiable project work beyond information already publicly available, we may seek your permission where appropriate.
If you do not want your project referenced in our portfolio or marketing, please let us know.
16. Confidentiality
We will take reasonable steps to keep confidential any non-public business information you provide to us in connection with our services.
We will not intentionally disclose confidential information to third parties except where:
necessary to provide the agreed service;
you have authorised us to do so;
required by law; or
the information is already publicly available through no breach by us.
17. Data Protection and Privacy
We process personal information in accordance with applicable UK data protection law and our Privacy Policy.
Our Privacy Policy explains what information we collect, why we collect it, how it is used and the rights available to you.
Where our services require us to process personal information on your behalf, additional data protection terms may be required depending on the nature of the service.
18. Website Information
We make reasonable efforts to ensure that information on our website is accurate and up to date.
However, website content is provided for general information and may be changed or updated from time to time.
We do not guarantee that our website will always be available, uninterrupted or free from technical errors.
19. Third-Party Links
Our website may contain links to third-party websites, platforms or services.
These are provided for convenience or informational purposes. We do not control third-party websites and are not responsible for their content, availability, privacy practices or terms.
20. Limitation of Liability
Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.
Subject to applicable law, Helping Trades Scale will not be liable for indirect or consequential losses arising from the use of our services, including loss of profits, revenue, business opportunities, anticipated savings or goodwill.
We will also not be responsible for losses resulting from circumstances outside our reasonable control, including changes or actions taken by Google or other third-party platforms.
Where legally permitted, our total liability arising from a particular service will not exceed the total amount paid to us for the service giving rise to the claim.
21. Suspension or Termination of Services
We reserve the right to suspend or terminate services where:
payment remains overdue;
you materially breach these Terms;
you use our services for unlawful, fraudulent or misleading purposes;
you refuse to provide information reasonably required to perform the service;
continuing the work could breach third-party platform rules or applicable law; or
your behaviour towards us or anyone working on our behalf is threatening, abusive or otherwise unacceptable.
Where reasonably possible, we will attempt to resolve the issue before terminating the service.
22. Events Outside Our Control
We will not be responsible for failure or delay in performing our obligations where this is caused by circumstances outside our reasonable control.
This may include internet or hosting outages, third-party service failures, changes to online platforms, cyber incidents, severe weather, power failures or other events that could not reasonably have been prevented.
23. Changes to These Terms
We may update these Terms from time to time to reflect changes to our services, business practices or legal requirements.
The latest version will be published on our website together with the date it was last updated.
Where a material change affects an ongoing paid service, we will provide reasonable notice where appropriate.
24. Severability
If any provision of these Terms is found to be unlawful, invalid or unenforceable, the remaining provisions will continue to apply.
25. No Waiver
If we do not immediately enforce a provision of these Terms, this does not mean that we have waived our right to enforce it later.
26. Governing Law
These Terms and any dispute or claim arising from them will be governed by the laws of England and Wales, unless applicable law requires otherwise.
The courts of England and Wales will have jurisdiction over disputes arising in connection with these Terms, subject to any mandatory legal rights that apply.
